Under the present tribunal system workers have a substantially greater chance of winning at tribunal if receiving representation.
We therefore regret that WorkRep is not always able to offer representation.
If we are unable to represent you, you should either think about representing yourself or find a lawyer who specialises in employment law, who at the very least deals regularly with employment cases. It is a bad idea to use the services of a generalist lawyer who rarely deals with employment cases.
Before you decide to pay out of your own pocket for a lawyer you really do need to think very carefully about how much you could win at a tribunal against the very steep prices charged by lawyers.
Unless your case is a special one and you are a high earner, do not use the extremely high awards sometimes reported in the press as a benchmark as to the award you might receive in your case. People who take their cases to tribunal on this basis have been very badly disappointed. They have moreover ended up very seriously out of pocket with all that entails.
If you can not find anyone to represent you the only option might be for you to become a diy lawyer.
WorkRep supports workers representing themselves throughout their case with free advice by telephone, email and Skype. For more information as to our terms and conditions in offering our free advice please read the relevant page of the Site Info section.
Taking your employer to tribunal on your own might sound daunting now and the hurdles to overcome are indeed great. However if you have the time, energy, a willingness and ability to learn a lot relatively quickly, a determination to persevere, and can give attention to detail, you could find that taking your employer to an employment tribunal is a useful and empowering experience.
You might even find at the end that you quite enjoyed yourself (especially if you win).
