When does the clock start ticking in a disability discrimination case?

Matuszowicz v Kingston Council - Court of Appeal (CA) 2009

In Matuszowicz v Kingston Council a disabled teacher was claiming that necessary adjustments had not been made for him to be able to continue working.

The CA held that where an employer had failed to take a decision about reasonable adjustments the tribunal would have to decide on an arbitrary start date for the time limitation.

The time limitation would run according to Paragraph 3 schedule 3 of the Disability Discrimination Act 1995 (DDA) , the expiry period within which the adjustments might reasonably have been expected to be made.
